Terms & Conditions for SEA - Sacred Energy Awakening
Overview
These terms and conditions (this "Agreement" or "Terms") is a legal agreement between you and Sacred Energy Awakening (hereinafter "SEA" or "S.E.A"). This Agreement annuls and voids all previous agreements. The Site (sacredenergyawakening.com) is operated by SEA. Throughout the Site, the terms "we", "us" and "our" refer to SEA. This Site, including all information, tools, and services available from this Site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
Acknowledgment and Consent
I understand that SEA sessions are complementary energy-based approaches to health and healing that can assist my body in its natural ability to heal. I fully acknowledge and understand that this is accomplished through the use of contact and/or non-contact touch.
I desire to participate in Sacred Energy Awakening (SEA) sessions at a yoga studio, other locations, at home (via remote), or in retreat facilities.
Representations
I represent that:
I am physically able to engage in the Activity, including but not limited to handling my mat, and personal belongings, and participating in provided snacks.
Disclaimer and Terms of Use/Consent Form for Session
I recognize that SEA sessions are supplemental energy-based approaches to health and wellness, designed to augment my body's inherent healing capabilities. This process involves both contact and non-contact touch, which I fully comprehend and accept.
I understand that SEA sessions are adjunct therapies, not intended to substitute any medical treatments currently prescribed by my physicians or any other medical care they may recommend.
I understand that Iskra Tsenkova will not diagnose any medical conditions, prescribe treatments for any medical issues, nor guarantee specific outcomes from the sessions I receive. I am encouraged to consult a licensed medical practitioner for any physical or psychological issues I may have. SEA sessions are not alternatives for medical or psychological attention, examination, diagnosis, or treatment.
I understand that SEA sessions may involve physical movements and offer an opportunity for stress reduction and improved mental wellness. As with any physical activity, the risk of injury, potentially severe or life-threatening, is always present and cannot be entirely eliminated. If I experience any pain or discomfort, I will heed my body, cease the activity, and seek support from the instructor. I will maintain a steady breath throughout. I accept full responsibility for any and all damages I may incur through participation.
Iskra Tsenkova or any SEA Facilitator is neither available nor trained to handle emergency or urgent physical health crises. In case of a psychological emergency, please contact L.A. County Mental Health/Crisis Line: 800-854-7771 or dial 911 for a physical emergency.
No one under the age of 18 will be allowed to attend Iskra Tsenkova’s classes or events without the accompaniment of a parent or guardian.
I understand that all client information and records will be treated confidentially. My experiences during these sessions are confidential, subject to the standard exceptions governed by State or Federal laws/regulations, or if there is reason to believe that I may inflict harm upon myself.
SEA sessions are generally considered safe. However, given the intense transmission of energy, be aware that it can sometimes release unprocessed emotions. This release is a critical part of the process, and it's recommended to allocate time after the session to support integration. SEA sessions are not recommended for individuals prone to manic, delusional, or psychotic episodes.
I affirm that a licensed physician has verified my physical and mental health, affirming my ability to participate in such a program. Additionally, I will inform the instructor of any medical conditions or physical limitations before the class or session. If I am pregnant, become pregnant, or am post-natal or post-surgical, my signature verifies that I have obtained my physician's approval to participate.
I affirm that the decision to practice SEA sessions is mine alone and participation is at my own risk. Unless in the case of gross negligence or malpractice, I, or my representative(s), agree to fully release and hold harmless Iskra Tsenkova from and against any and all claims or liability of whatsoever kind or nature arising out of or in connection with my SEA sessions/classes/events.
Remote SEA Sessions
For Remote SEA Sessions conducted via online platforms, the same terms and conditions apply. Participants must ensure they have a safe, private space to engage in the session. By participating in remote sessions, you agree to the same risks and responsibilities as outlined above.
Cancellation and Refund Policy
No refunds will be issued. Full charges apply for “No Shows”, and they will not be rescheduled. A minimum of 48 hours' notice is required for rescheduling. It is your responsibility to ensure that we receive your notification about rescheduling. Individual sessions cannot be transferred to anyone else.
We reserve the right to refuse service.
By attending Iskra Tsenkova’s classes, sessions, and events, you acknowledge that you have read, understood, and accepted the Terms of Use and the disclaimers contained therein.
As these policies are publicly visible and available, it is understood that anyone attending Iskra Tsenkova’s classes, sessions, and events does so with the acknowledgment that they have read the above waiver, comprehend its meaning and legal implications, and fully agree to the terms and conditions stipulated herein.
By purchasing a class/session, you acknowledge the cancellation policy, and you understand that Iskra Tsenkova is not a doctor, counselor, or lawyer, and she is not providing any medical, psychological, or legal advice. Although SEA events/classes/sessions are considered for entertainment purposes, Iskra Tsenkova invests her heart and soul into assisting others.
We may amend these policies from time to time. Changes to these policies will be posted on our website. We encourage you to review our policies periodically, as visiting our website implies acceptance of any such changes.
I have read, fully understand, and agree to the above terms of this Liability Waiver Agreement. I am electronically signing this agreement voluntarily, checking I have read and agree to these terms understanding that my electronic signature or checkmark acknowledgement signifies a complete and unconditional release of all liability to the greatest extent allowed by law in the United States and the State of California.
No refunds will be issued. A 48-hour prior notice is required to reschedule. No shows will not be refunded or rescheduled.
Acknowledgment
Iskra Tsenkova is not a doctor, lawyer, or counselor and she is not providing anyone with any medical, legal, or psychological advice.
Assumption of Risk
I fully understand that there are dangers, inherent and otherwise, in the Activity and in engaging in the Activity. I further understand that my participation in the Activity may expose me to the risk of personal injury or death. I hereby acknowledge that I am participating of my own free will in the Activity and I agree to assume the full risk of any injuries and/or damages and/or losses of any kind, regardless of severity and including death, that may occur in connection with my participation in the Activity.
Waiver and Release of Liability
I, intending to be legally bound for myself and my heirs, personal representatives, next of kin, and anyone who might make a claim on my behalf, hereby waive, release, and discharge SEA, Iskra Tsenkova, and Sacred Energy Awakening LLC, and their officers, agents, employees, and volunteers from any and all claims for damages and/or liability, whether caused by any active or passive negligent act or omission of SEA or Iskra Tsenkova or their officers, agents, employees, and/or volunteers, or otherwise related to my participation and promise not to sue SEA or Iskra Tsenkova or their officers, agents, employees, and/or volunteers for any damages I incur in connection with the Activity. This release and waiver extend to all claims of every kind or nature whatsoever, foreseen or unforeseen, known or unknown.
I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease, or property losses, or any other loss, including but not limited to claims of negligence, and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.
Compliance with All Rules
I agree to obey all rules and regulations applicable to the Activity and instructions provided by Iskra Tsenkova and volunteers during my participation in the Activity.
Choice of Law
I understand and agree that the law of the State of Wyoming will apply to this contract.
Miscellaneous
I acknowledge and agree that this Agreement is binding upon my heirs, assigns, and legal representatives. I agree that this Agreement is intended to be as broad and inclusive as is permitted by law. I further agree that this Agreement is severable and that if any clause is found invalid, the balance of the Agreement will remain in effect, valid, and enforceable.
